Using our website
Terms and Conditions
Last updated:
These terms explain the use of adverixtech.com. They apply to website visitors and are separate from any agreement for paid services.
1. About these terms
This website is operated by Adverix Digital LP, using the public-facing brand Adverix Digital. In these terms, “we”, “us” and “our” refer to Adverix Digital LP, and “you” refers to the person visiting the website or the business on whose behalf they are acting.
The website is primarily intended for businesses interested in digital marketing, performance advertising, analytics and technology services. Please read these terms before using it. If you do not agree with them, please stop using the website. Their application remains subject to applicable law and your rights that cannot lawfully be excluded.
2. Separate agreements for paid services
The website provides general information. Browsing it, following a link or sending an enquiry does not, by itself, place an order, appoint us to act for you or create a paid client engagement. A service description is not a binding quotation or commitment to deliver a particular outcome.
Paid services require a separate written agreement with the client. That agreement should set out the agreed scope, deliverables, responsibilities, fees, payment arrangements, timescales, ownership and licences, confidentiality, data-processing obligations, liability and termination terms, as appropriate to the engagement.
The agreed client contract governs those services and takes precedence over these website terms on service-related matters. These terms do not amend an existing client contract or replace a negotiated services agreement. We do not guarantee advertising results, revenue, rankings, conversion rates or other commercial or technical outcomes through the website.
3. Lawful and responsible use
You may use the website to learn about our business, evaluate our services and contact us for legitimate enquiries. You must not:
- use it for unlawful, fraudulent, misleading or abusive purposes, or infringe another person’s rights;
- attempt unauthorised access to the website, its systems or information;
- introduce malicious code or deliberately interfere with its security, availability or normal operation;
- impersonate another person or misrepresent your authority to act for a business; or
- use our contact details for abusive communications or unlawful marketing.
Nothing here prevents lawful reporting of a suspected security issue or the exercise of statutory rights. If you identify a potential issue, contact us without accessing information or disrupting services beyond what is lawfully authorised.
4. Website content and intellectual property
Rights in website materials, including text, graphics, branding and code, belong to us or their respective rights holders, where protected by law. You may view the website and make reasonable copies for your internal evaluation of our business and services.
Do not remove ownership notices or present our material as your own. Commercial republication, distribution or other reuse requires the relevant permission unless permitted by law. No ownership or wider licence is transferred simply by visiting. Lawful quotation, accessibility uses and other applicable statutory exceptions are not restricted by these terms.
5. Information and business decisions
We aim to provide useful and accurate information, but content may change and may not address your circumstances. It is general business information, not tailored professional, legal, financial or technical advice. Contact us to confirm information material to a proposed engagement before relying on it.
You remain responsible for evaluating whether a proposed service is suitable for your business. This section does not restrict liability for fraud or misrepresentation where it would be unlawful to do so.
6. Availability and security
We may update, maintain, suspend or withdraw parts of the website. We do not promise uninterrupted availability or that every error will be corrected immediately. We will take reasonable steps appropriate to the circumstances when maintaining the website.
You are responsible for your own devices, network access and appropriate security precautions. We cannot promise that any internet service is entirely free from security risks. Website changes or interruptions do not, by themselves, change obligations under a separate client agreement.
7. Links to other websites
Links to independent websites are provided for convenience or reference. Unless we expressly say otherwise, a link does not imply endorsement, approval or a commercial relationship. Those websites are controlled by their own operators and have their own terms and privacy arrangements.
You may link to our publicly accessible website fairly and lawfully, without suggesting an affiliation or endorsement that does not exist. Do not frame it or otherwise misrepresent its source in a way that infringes our rights or misleads visitors.
8. Liability and rights that remain protected
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited. Nothing removes rights or remedies you have under mandatory applicable law, including consumer rights where they apply.
Any responsibility for loss arising from use of the website is determined under applicable law, including requirements of fairness and reasonableness where relevant. The statements about information, availability and external links do not override those requirements.
Liability for paid services is addressed in the applicable client agreement, subject to the law. These website terms are not intended to create a separate services liability regime.
9. Personal information and enquiries
Please read our privacy information for information about handling personal data. It is separate from these website-use terms. You can use the contact details below to ask questions about privacy.
Do not send passwords, payment details or unnecessary sensitive or confidential material in an initial enquiry. Sending an enquiry does not, by itself, establish a confidentiality agreement, transfer intellectual-property rights or authorise us to start paid work. Confidentiality obligations required for an engagement should be agreed separately, without affecting duties that already arise under law.
10. Updates to these terms
We may update these terms to reflect changes in the website or applicable requirements. The date near the title identifies the version published on this page. Please check the page when you return.
Changes apply to future use as permitted by law. They do not retrospectively alter accrued rights, settle an existing dispute or amend a separate client contract merely because this page is updated. Amendments to a client contract must follow its agreed process.
11. Governing law and resolving concerns
Please contact us first if you have a concern about the website so that we have an opportunity to consider it. This does not prevent you from exercising a legal right or seeking a remedy.
These website terms are governed by the laws of Northern Ireland. To the extent permitted by applicable law, the courts of Northern Ireland have non-exclusive jurisdiction over disputes relating to them.
If you are a consumer, this does not deprive you of mandatory protections under the law that applies to you or any right to bring proceedings in another court where applicable law provides for that right. These terms do not override a governing-law or dispute-resolution clause in a separate client agreement.
